Terms and Conditions

DNA and PBFT Results are provided. 

SALES AGREEMENT 

BUYER acknowledges that SELLER makes no warranty as to the health, condition, or lifespan of the bird(s). BUYER expressly accepts the bird(s) “as-is.”

All sales are final. No returns or refunds; While SELLER makes every effort to ensure said bird(s) are pet quality, and well socialized,  there is no guarantee on personality, pet, or breeding potential. BUYER is solely responsible for the training and behavior of said bird(s).


All birds purchased from My Little Aviary are sold “AS‐IS,” with the said test we perform and there are no other warranties, express or implied. Buyer understands and agrees that the sale is final and there is no guarantee/refund or exchange.

WHEN YOU BUY A BIRD FROM US, YOU ARE AWARE OF THE RISKS THAT YOU INVEST IN A LIVE BIRD, ANYTHING LIVE CAN DIE ON ANY GIVEN MOMEMENT FOR A LARGE NUMBER OF REASONS, AND IS NOT COVER FOR ANY REASON. ONCE A BIRD LEAVES OUR AVIARY IT IS EXPOSED TO THE OUTSIDE ENVIRONMENT AND ANY INFECTION, DISEASE, BACTERIA OR TRAUMA is 100% THE RESPONSIBILITY OF THE CUSTOMER.

DEPOSIT AND PAYMENT

All deposits are non-refundable. 

If the BUYER does not make arrangements to have “paid in full bird(s)” shipped to him/her within 14 days of being informed that the bird(s) is ready for delivery/pick-up, the bird(s) will be forfeited by BUYER without refund of initial deposit or any additional money sent towards bird(s) remaining balance received by SELLER.

SHIPPING  (Shipping is not available at this time)


Live Arrival Guarantee for Delta. If a bird has perished upon arrival, the customer is required to file a claim with the associate at the counter upon pickup and collect their name and copy of claim number. Any amount awarded to you, will be awarded to you directly by Delta. Should you choose to replace a perished bird, shipping costs are solely the customer’s responsibility. To honor our guarantee, we require the following: 1. your birds be picked up within 60 minutes of their arrival, 2. notification must be made to Kathryn Smith while still at the Delta counter and 3. A photograph of the perished animal must be provided at the Delta counter. We do not ship USPS.

This agreement has been read and understood by both parties, and by executing the Agreement, the parties, expressly intending to be legally bound, agree that all terms and conditions contained herein are acceptable and binding.
